- The regulation of Air Transport Documents under Article 23 UCP 600 By:-Arnilt Durpont
Article 23 of the UCP 600 states the requirements which a air transport document has to meet if banks are to accept it as compliant for a presentation made under a letter of credit.
Article 23 deals with carrier-issued air transport documents, evidencing the promise to transport the goods from the airport of departure to the airport of destination. Typically these are called “airway bill” or “consignment note”. As with all shipping documents, however, it is irrelevant how they are called or named. The ICC thusly:
“As long as an air transport document issued by a freight forwarder fulfils the requirements of UCP 500 sub-Article 27 (a)(i) in conjunction with UCP 500 Article 30, and thereby clearly shows that it is a carrier-type document, there is no ground for rejecting the air transport document solely for the reason that it is named House Air Way-bill.”
- Insurance documents and letters of credit By:-Arnilt Durpont
Article 28 UCP 600 prescribes the requirements an insurance document has to meet if it is to be accepted by a bank under a letter of credit. Previously detailed in Articles 34 to 36 UCP 500, the revision has not led to substantive changes, except for
- Admissibility of signatures by agents or proxies (Article 28 a UCP 600)
- Prescribed coverage amount is minimum coverage (Article 28 f (ii) UCP 600)
- Admissibility of any exclusions of liability (Article 28 I UCP 600)
Insurance documents include insurance policies, insurance certificates and declarations of insurance. These still need to be signed by underwriters, insurance companies or their agents and proxies. Cover notes, issued by insurance brokers are not acceptable.
When a consortium is the insurer the signature of only one member of the consortium is sufficient. The other members of the consortium need not be mentioned. This still does apply when the members of the consortium are not jointly and severally liable but only severally or proportionately liable, since the other members of the consortium and their respective quotas of liability can be determined through the consortium leader.
- How to partially draw on a letter of credit By:-Arnilt Durpont
Article 31 UCP 600 permits the beneficiary to partially ship and draw on the letter of credit. As beneficial as this provision is for the beneficiary, the applicant runs the risk that he does not receive all the goods/services/performance he ordered. Rather, the beneficiary is permitted to ship only a portion of the agreed upon goods at the "last minute" before expiration of the LC and still get paid under the LC. In case the Applicant wants to protect himself against "last minute" shipments, he should open the LC in such a way, that he either prohibits partial shipments
or at least sets deadlines for partial shipments.
The following, will explain what else to consider when opening a letter of credit.
